1.2 — Scope of This Policy
This policy applies to personal information collected through our Website (ausfitnessgym.com.au), including via contact forms, membership applications, newsletter sign-ups, online payments, and cookies/analytics. Information collected in-person at the physical Club is also governed by this policy and, where applicable, your Membership Agreement.
1.3 — Why We Must Have This Policy
We are required to maintain this Privacy Policy under APP 1 of the Privacy Act 1988 (Cth). In particular, because we collect health information (via pre-exercise questionnaires) — classified as sensitive information under the APPs — this obligation applies to us regardless of our annual turnover.
By using this Website and submitting personal information, you consent to the collection and use of your information as described in this policy. Where we rely on consent as our legal basis, you may withdraw it at any time by contacting us — without affecting the lawfulness of any prior processing.

2.4 — Anonymity Option (APP 2)
Under APP 2, you have the option of dealing with us anonymously or under a pseudonym where it is lawful and practicable. You may browse this Website without providing personal information. However, you cannot complete a membership application or access personalised services without identifying yourself.

The majority of personal information we hold is collected directly from you when you interact with the Website — via forms, applications, or payments.
3.2 — Automatically

- Pay Choice — confirming transaction status and notifying us of failed payments (consistent with clause 5 of the Membership Agreement);

- Debt recovery providers — where we engage them following unresolved arrears (consistent with clause 13.1 of the Membership Agreement).

4.1 — Notice at Point of Collection
Consistent with APP 5, whenever you submit personal information through our Website (including via contact forms, membership applications, or payment forms), we will take reasonable steps to notify you — at or before the time of collection — of the following:
- That Au Fitness Pty Ltd (ACN: 687 272 180) trading as Aus Fitness 24/7 is collecting the information;
- The purpose for which we are collecting it;
- The types of third parties to whom we may disclose it;
- That this Privacy Policy contains further information about how we manage personal information and how to access and correct it;

- Administering your membership account and communicating membership-related notices;
- Conducting pre-exercise health screening (as required by clause 12.1 of the Membership Agreement);
- Sending transactional communications — receipts, booking confirmations, and membership updates.
6.2 — Secondary Use (APP 6.2)
We will not use or disclose your personal information for a purpose other than the primary purpose of collection unless:
- You have consented to the secondary use or disclosure;
- The secondary purpose is directly related to the primary purpose and you would reasonably expect us to use it in that way; or
- Use or disclosure is required or authorised by law.
6.3 — Marketing
With your consent, we may send you promotional emails, newsletters, and offers about Aus Fitness 24/7. See Section 13 for your opt-out rights. We will not use your information for marketing without consent.
